Rental Agreement
This Rental Agreement (“Agreement”) is entered into between Legacy Stays LLC (“Legacy Stays,” “Property
Manager,” “we,” “us,” or “our”), acting on behalf of the property owner, and the individual completing the
reservation (“Guest,” “you,” or “your”). This Agreement sets forth the terms and conditions governing your
reservation and stay at a Legacy Stays property.
Reservations & Payment
Booking Channels
Reservations may be made through the Legacy Stays website or through authorized third-party booking platforms.
Payment Authorization
By completing a reservation, you authorize Legacy Stays or the applicable booking platform to charge the payment
method provided for:
- rental charges
- cleaning fees
- pet fees, if applicable
- taxes
- any additional fees disclosed during booking
- amounts due for damages, policy violations, or approved additional services
Payment Terms
Payment terms will be presented during the booking process and may vary depending on the booking date, property,
length of stay, and booking channel.
Failed Payments
Failure to complete required payment by the due date may result in cancellation of the reservation.
Pricing Errors
If a pricing or listing error occurs, we reserve the right to correct the error and will provide you the option
to proceed at the corrected price or cancel for a full refund.
Reservation Acceptance
We reserve the right to decline or cancel a reservation that:
- does not meet booking requirements
- fails verification or screening requirements
- appears fraudulent
- violates applicable policies or house rules
Guest Verification & Screening
To help protect guests, neighbors, and property owners, Legacy Stays may require identity verification and guest
screening prior to confirming a reservation. We may use third-party service providers to assist with identity
verification, fraud prevention, and risk assessment.
If verification is required, you agree to provide accurate information and complete the requested steps promptly.
Failure to complete required verification may result in denial or cancellation of the reservation. All personal
information collected in connection with verification is handled in accordance with our Privacy Policy.
Rental Period
Your rental period begins at the designated check-in time on the arrival date and ends at the designated
check-out time on the departure date listed in your reservation confirmation.
Unless otherwise specified:
- Check-in: 3:00 PM
- Check-out: 10:00 AM
Early arrival or late departure must be approved in advance. For stays of 30 nights or longer, additional or
separate terms may apply.
Check-In
Check-in instructions will be provided once the reservation is confirmed and all applicable booking requirements
have been satisfied. Many Legacy Stays properties use self check-in through keyless entry. You are responsible
for keeping access information confidential and not sharing entry codes with unauthorized persons. Please notify
us in advance when possible if you expect to arrive very late.
Check-Out
Standard Check-Out
Unless otherwise specified, check-out time is 10:00 AM.
Late Check-Out Requests
Late check-out may be available upon request and subject to scheduling and cleaning requirements. When approved,
late check-out may be:
- complimentary until 12:00 PM, when available
- available for an additional fee after 12:00 PM, if operationally feasible
Unauthorized Late Departure
Late departures without prior approval may result in additional charges, including hourly late check-out charges
or up to the full nightly rate if the delay materially affects cleaning schedules, incoming guests, or property
operations.
Departure Condition
Before departure, guests should:
- dispose of trash in designated containers
- bag garbage properly
- leave used dishes in reasonable order
- secure the property as instructed
- leave the home in reasonably clean condition
Guest Responsibilities & Conduct
The property may be used only for temporary residential lodging purposes. You agree to:
- follow all house rules and property instructions
- respect neighbors and community standards
- maintain the property in reasonable condition
- use amenities and furnishings responsibly
- ensure that all occupants and visitors comply with this Agreement
You are responsible for the conduct of all occupants and visitors associated with your reservation.
The following activities are strictly prohibited under all circumstances:
- illegal activity of any kind
- smoking or vaping inside the property
The following activities are not permitted unless expressly approved in writing by Legacy Stays:
- parties, events, or large gatherings
- commercial use of the property (including filming or photography for commercial purposes)
- unauthorized pets
- subletting or transferring the reservation to another party
- exceeding the stated occupancy limit for the property
Violation of this Agreement or house rules may result in additional charges, cancellation of the stay without
refund, or removal from the property, depending on the nature of the violation.
Occupancy & Visitors
Each property has a maximum occupancy limit stated in the listing or reservation details. That limit includes all
overnight occupants, including children and infants, unless otherwise stated. All overnight guests must be
included in the reservation.
Reasonable daytime visitors are generally permitted so long as they do not create parking, noise, safety, or
occupancy issues, and do not constitute a party or event. Unauthorized occupants or excessive visitors may result
in additional charges, cancellation of the reservation without refund, or removal from the property.
Parties, Events & Excessive Noise
Parties, large gatherings, and events are not permitted unless expressly approved in writing in advance. Guests
must comply with applicable local noise ordinances and community rules, and must observe quiet hours from 10:00
PM to 8:00 AM, unless otherwise posted for a particular property.
Unauthorized events, repeated noise complaints, or conduct that disturbs neighbors may result in immediate
termination of the reservation without refund and may also result in additional charges for damages, extra
cleaning, fines, or other losses caused by the violation.
Property Condition & Damage
Please inspect the property upon arrival and promptly report any pre-existing damage, missing items, or
maintenance concerns. Guests are responsible for any damage to the property, furnishings, appliances, fixtures,
or contents caused during the stay beyond normal wear and tear.
Chargeable damage or loss may include, by way of example:
- broken or missing items
- stains, burns, or tears
- pet-related damage
- damage caused by misuse or negligence
- smoking-related odor or residue
- excessive cleaning beyond normal turnover standards
If damage, loss, or excessive cleaning is identified, Legacy Stays may charge the cost of repair, replacement,
remediation, or additional cleaning to the payment method associated with the reservation, to the extent
permitted by the booking channel and applicable law.
If a security deposit is required for a particular property, it will be disclosed during booking. If you dispute
a damage charge, please contact us promptly and provide any relevant information or supporting documentation.
Housekeeping & Cleanliness
Legacy Stays properties are professionally cleaned between stays, but daily housekeeping is not provided unless
specifically offered. Guests are expected to maintain the home in reasonably clean condition during the stay.
Before check-out, guests should:
- place trash in designated containers
- bag garbage properly
- leave dishes in reasonable condition
- remove excessive food waste and spills
If the property requires cleaning beyond normal turnover standards, an additional cleaning fee may apply.
Examples include excessive trash, biohazard cleanup, strong smoke odors, glitter or confetti, or other
conditions requiring unusual time or materials to remediate. Optional mid-stay cleaning may be available for
some longer stays at an additional cost.
Pets
Pets are permitted only at designated pet-friendly properties and only with advance approval when required. Where
applicable, pet fees will be disclosed during booking. Guests with approved pets agree to keep pets under
control, clean up after them, and prevent pet-related damage or disturbances.
Unauthorized pets may result in additional fees, extra cleaning charges, or cancellation of the reservation.
Legitimate service animals are welcome in accordance with applicable law.
Smoking
Smoking and vaping are strictly prohibited inside all Legacy Stays properties. If outdoor smoking is permitted at
a property, guests must do so responsibly, dispose of waste properly, and avoid damage or disturbance to
neighbors.
Evidence of indoor smoking or vaping may result in additional cleaning, deodorization, remediation, or damage
charges, and may also result in termination of the reservation without refund.
Failure to Vacate / Holdover
Guests must vacate the property by the designated check-out time unless a late check-out has been approved in
writing. If a guest fails to vacate as required, Legacy Stays may assess additional charges, including late
departure fees, relocation costs for incoming guests if applicable, and other reasonable losses caused by the
delay.
For stays under 30 nights, this Agreement is intended as a short-term lodging arrangement and not as a
residential lease. For stays of 30 nights or longer, additional terms may apply.
Maintenance, Repairs & Access
Please report maintenance issues, safety concerns, or malfunctioning equipment as soon as possible. We will make
reasonable efforts to address issues promptly, with response time depending on the nature and urgency of the
issue.
Legacy Stays, the property owner, or authorized vendors may enter the property when reasonably necessary for:
- emergency response
- maintenance or repairs
- safety concerns
- inspections
- compliance verification relating to this Agreement
For non-emergency access, we will make reasonable efforts to provide notice when practicable. If a material issue
significantly affects your stay and cannot be reasonably resolved, we may offer a partial refund, relocation if
available, or another reasonable accommodation, as appropriate.
Security Devices & Privacy
Some Legacy Stays properties may utilize exterior security devices for safety, property protection, and access
management purposes. These devices may include exterior security cameras or smart lock systems. Any such devices
will be clearly disclosed in the property listing or check-in materials when applicable.
Exterior security devices, if present, are positioned to monitor exterior areas such as entrances, driveways, or
other public-facing access points and are not intended to monitor private guest areas. No cameras or recording
devices are installed inside guest living areas, including bedrooms, bathrooms, or other private interior spaces.
Guests may not tamper with, disable, or interfere with authorized security, access-control, or safety devices
located at the property, including but not limited to smoke detectors, carbon monoxide detectors, or smart lock
systems.
Legacy Stays collects and processes personal information in accordance with its Privacy Policy and applicable
privacy laws.
Liability & Assumption of Risk
Guests are responsible for their own conduct and the conduct of all occupants and visitors associated with the
reservation. Legacy Stays and the property owner are not responsible for loss, theft, or damage to personal
belongings left at the property.
Guests assume the ordinary risks associated with use of the property and any disclosed amenities, including
outdoor areas, stairs, decks, grills, hot tubs, pools, fire features, and similar amenities, except to the
extent caused by our negligence or other liability that cannot be disclaimed under applicable law.
To the fullest extent permitted by law, Legacy Stays’ liability arising out of a reservation or stay will not
exceed the total amount paid for the reservation, except where such limitation is prohibited by law.
Indemnification
To the fullest extent permitted by law, the Guest agrees to indemnify and hold harmless Legacy Stays, the
property owner, and their respective agents, employees, and representatives from third-party claims, losses,
liabilities, and expenses arising out of:
- the Guest’s use of the property
- violations of this Agreement or house rules
- the acts or omissions of the Guest or the Guest’s occupants or visitors
This provision does not apply to the extent a claim arises from our gross negligence, willful misconduct, or
other liability that cannot be limited by law.
Cancellation & Refunds
The cancellation policy applicable to your reservation will be disclosed during the booking process and/or in
your reservation confirmation. Cancellation terms may vary depending on the property, booking dates, stay
length, and booking channel.
Guests are responsible for reviewing the applicable cancellation policy before completing a reservation. We
recommend travel insurance for unforeseen disruptions to travel plans.
Force Majeure / Property Unavailability
If the property becomes unavailable due to circumstances beyond our reasonable control, including severe
weather, natural disaster, fire, government action, utility disruption, public emergency, or major property
damage, we may cancel the reservation. In such a case, we may, at our discretion:
- provide a comparable substitute property if available, or
- refund amounts paid for the unavailable portion of the stay
Except as required by law, Legacy Stays will not be responsible for additional consequential costs such as
travel expenses, alternate lodging booked independently, or other indirect losses.
Payment Disputes & Chargebacks
By completing a reservation, you authorize charges consistent with the reservation, disclosed fees, and amounts
properly due under this Agreement. If you have a billing concern, you agree to contact us first and allow a
reasonable opportunity to review and respond before initiating a chargeback or payment dispute, unless
prohibited by law or by the terms of the applicable booking platform.
Legacy Stays reserves the right to contest improper chargebacks and to recover amounts properly owed, together
with reasonable processing, collection, or administrative costs where permitted by law.
Reviews, Photos & Content
If you voluntarily submit a review, testimonial, photo, or similar content to Legacy Stays, you grant us a
non-exclusive, royalty-free license to use that content for business, marketing, or promotional purposes, unless
you request otherwise in writing at the time of submission.
Guests may take personal photos and videos during their stay for private, non-commercial use. Commercial
photography, filming, production activity, or content creation primarily intended for advertising, brand
promotion, monetized media, or other commercial purposes requires prior written approval and may be subject to
additional terms or fees.
Third-Party Bookings
For reservations made through Airbnb, Vrbo, Booking.com, or another third-party platform, the platform’s terms
and policies govern the booking transaction, payment processing, and platform-specific cancellation procedures.
Guests booking through a third-party platform must also comply with the property rules, occupancy limits, and
stay-related policies communicated by Legacy Stays for the duration of the stay. If there is a conflict between
this Agreement and the mandatory terms of the applicable booking platform, the platform’s mandatory terms will
control to the extent of that conflict.
Governing Law & Dispute Resolution
This Agreement is governed by the laws of the State of North Carolina, without regard to conflict of law
principles. Before filing a formal legal claim, both parties agree to attempt in good faith to resolve the
dispute informally.
If litigation is necessary, venue shall lie in the appropriate state or federal court in North Carolina, unless
applicable law or a controlling third-party booking platform requires otherwise.
Miscellaneous
This Agreement, together with applicable house rules, listing disclosures, and cancellation terms, constitutes
the full agreement between the parties regarding the stay. If any provision of this Agreement is found
unenforceable, the remaining provisions will remain in effect. A failure to enforce any provision of this
Agreement will not constitute a waiver of that provision. The version of this Agreement in effect at the time of
booking will govern the reservation.

Acceptance of Terms
By completing a reservation through the Legacy Stays website, you acknowledge that you have read, understood,
and agree to this Rental Agreement & Terms of Stay. For reservations made through a third-party booking
platform, the platform’s booking terms will apply to the reservation transaction, and you agree to comply with
the stay-related rules and policies applicable to the property during your stay.
